Important Notice
Braemer Towers Update!

The Worcester County Health Department has directed Braemar Towers to test monthly for Legionella bacteria through October 17, 2005. The Braemar Towers has reported that the April and May tests were free of Legionella bacteria. In addition, a Chlorine Dioxide Water Treatment System was placed in service on May 3, 2005. If all tests through October 17, 2005 are negative, the Worcester County Health Department will no longer require Braemer Towers to test for Legionella bacteria. However, Braemar Towers expects to continue testing the water to assure that it is free of bacteria and that the chlorine levels are correct. Braemar Towers has also issued “Unit Guidelines for Water Maintenance” to unit owners to ensure that the water system is maintained in as safe a manner as possible. - As reported by Joan Strang, Government Affairs Director

Braemer Towers Mandatory Disclosure

Please be advised that our legal counsel, Al Monshower, has stated that the existence of Legionnaires Disease at the Braemar Towers, is a material fact which a real estate licensee is required to disclose to all parties.

He is recommending that the disclosure be made in writing, and that it be made to any potential buyer and/or tenant prior to contract of sale. This disclosure should be made until such time as the appropriate county or city health department completes its treatment, inspection, and testing of the property and certifies that the cause of the Legionnaires bacteria has been remediated.

Please make sure that all of your agents are aware of this important issue.
